Q: What exactly is alternative dispute resolution (A.D.R.)?

A: Generally alternative dispute resolution is any means that are taken to settle a matter outside of court proceeding. Two common forms of alternative dispute resolution are mediation and arbitration.

Q: Aren't mediation and arbitration the same thing?

A: No; though similar in concept, there are major differences between them. In mediation, a neutral third party acts as a guide or a negotiator and assists the parties to create a resolution. In arbitration, an arbitrator, will review the facts of the matter, and render a decision based on those facts as they are presented.

Q: Why is alternative dispute resolution, arbitration, or mediation a better choice than a civil litigation trial?

A: Every situation is unique, so when dispute resolution is not an option litigation may be the only logical process. However, there are many benefits to resolving a dispute out of the court room. First and foremost is time. Time is money. When the progress of real estate, business or construction transactions are delayed due to disputes, the financial losses can add up very quickly.

There are other latent benefits that may be realized when reserving litigation as a last result in the handling disputes. For instance, there are few business relationships that continue after settling a matter through a court battle.
